Although this English-translated document is writen by me (UENO Tomohiro),
the Japanese version is a formal document.
It has became clear that PocketMascot provided from JGUI FOR POCKETPC. (Mr. Janusz Gerszberg) was created with a source code from Minute Mascot without my (UENO Tomohiro) permission, and they are sold as shareware.Although Minute Mascot is available as a freeware including a source code, this software has an original form of usage and distribution regulation, and I have not abandoned the copyright. Even he uses Minute Mascot's source code in Pocket Mascot, he doesn't have any reference or description about my name and/or Minute Mascot, and tells as he developed all works by himself. These are the acts which disregardes my copyright. I hereby protest him and I require that such act , which makes disadvantages me should be withdrawn.
The Minute Mascot ver1.0 became available to public as application for WindowsCE with sample data/documents/data creation manuals in English on February 9, 2001. Minute Mascot ver1.1 was introduced in Mado-no-mori on Feb 20, 2001 (Famous Japanese software site by Impress co.), and in May 29, 2001 won NEC Special Prize and the Mado-no-mori prize award at WindowsCE software contest 2001 held by Windows CE FAN and the support of Microsoft sponsorship. Furthermore, Minute Mascot's French site was introdued on March 3, 2001, and the sample data and the data creation manual for English / French / Italian / Japanese Roman alphabet version became avaliable with the courtesy of Mr. CakOS.
For Pocket Mascot, the free demonstration version and the 24.99 dollars shareware version became avaiable as application for PocketPC on August, 2001.
July 29, 2001 -- I received an proposal mail from Mr. |JG.| Janusz Gerszberg. In this mail, he says he has an idea of functional additions to a Minute Mascot, and he can also establish the english version of introduction site for Minute Mascot, and talks about making it as a shareware of 20 dollars, distributing profits at 50%-50%.
July 29, 2001 -- I replied him , writing that I don't want to get money with my software, and told that I don't permit him to use Minute Mascot's source code for the commercial purpose, but permit him to use Minute Mascot's source code only for the case of non-commercial purpose.
July 29, 2001 -- I received a mail from Mr. |JG.| Janusz Gerszberg, in it he wrote re-proposal making Minute Mascot as a shareware, and some idea for functional additions, and bug informations.
July 30, 2001 -- I replied him, writing that I have my thoery that money should not be received when programming for hobby, and answers to functional addition idea and a bug -- a letter was answered in the correspondence to the information
Since then, there was no contact from Mr. | JG.| Janusz Gerszberg. Existence of PocketMascot was discoverd by report to me from CakOS on August 25, 2001, and have found that Pocket Mascot was released without any notification to me.
September 1, 2001 -- I sent him a mail, writing that I protest to PocketMascot and have requests to him in it.
September 3, 2001 -- I received a mail from Mr. |JG.| Janusz Gerszberg, in it he wrote that Pocket Mascot is his original program and he doesn't accept my requests.
September 5, 2001 -- I sent him a mail, writing that I protest to PocketMascot and have requests to him again in it.
(Note) I have not recevied permission from Mr. | JG.| Janusz Gerszberg to open these mails to public withthis document, but posted for requirement of circumstances explanation, and a proof of piracy.
For following reasons, I judge that it was plagiarized.
(Note) I have not received permission from Mr. | JG.| Janusz Gerszberg to post skin.inf file in this document, but it has posted as information since they are required to prove software piracy.
- Minute Mascot saves one of the internal parameters as 4 bytes data in file with the name "__tmp" in program launch directory at the time of initialization, and the same name / same size file was also generated by the demonstration version of PocketMascot.
- Minute Mascot's data consists from image data files and a configuration file "skin.txt" inside folder located under directory where the execution file is stored. The data conposition of PocketMascot demonstration version is exactly same. (althogh configuration file name is skin.inf instead of skin.txt)
- EXE file for MIPS has neary 90 % similarity in the address area shown below, between MinuteMascot and PocketMascot. (EXE file size for MinuteMasoct: 38,912bytes,PocketMascot: 59,392bytes)

- The texts for Error Messages starting address [77A0- ] : MinuteMascot and [85C0- ] : PocketMascot is very similar (some part of them are completely same).
- MinuteMascot and PocketMascot have same resouce ID, the Icon resource ID is [106] and three dialog resouce ID are [105, 125, 126 ] .
- The string "JZC" which is used in Minute Mascot is included in Pocket Mascot MIPS demonstration version ver 1.7.0.
- The skin.inf file for PocketMascot is very similar to the skin.txt file for a Minute Mascot. (This may not be the obvious evidence of his piracy)
The distribution regulation of my site is shown on a Minute Mascot's distribution page, and the document (the English version document) for Minute Mascot's copyright and distribution regulations is included with Minute Mascot's archive. Although there's a difference between 'distribution regulation of this site' and 'the document within the archive', still both document talks about copyright and distribution restriction, and even, I explained about copyright to Mr. |JG.| Janusz Gerszberg in mail, and I believe that he knows I do not permit using a Minute Mascot's source code for commercial purpose.
I hereby demand Mr. | JG.| Janusz Gerszberg following items.
- Return the shareware fee to all customers
- Stop distribution and remove all items on Pocket Mascot.
- Accept your piracy use of sotware and apologize to all customers and me on Mr. |JG.| Janusz Gerszberg's website.
